1. Acceptance of Terms

By registering and using Nuntaria, you declare that you have read, understood, and accepted these Terms and our Privacy Policy. This agreement is legally binding.

2. Service Description

Nuntaria is a web platform that automates the monitoring of public data from official Colombian government sources. Currently, it tracks public tenders and judicial processes, and sends email notifications to users based on criteria configured by each user.

3. Eligibility

The service is available to any person of legal age with legal capacity to contract. By registering, you declare that you meet these requirements. If you are a minor, you may need authorization from a legal representative, in accordance with applicable legislation.

4. Account Creation and Use

To use Nuntaria, you must create an account by providing truthful information. You are responsible for maintaining the confidentiality of your credentials and for any use made from your account. We reserve the right to suspend or cancel accounts in case of misuse.

5. License of Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the platform in accordance with these Terms. This license does not authorize you to modify, distribute, sublicense, or commercially exploit the content or code of Nuntaria.

6. Acceptable Use and Prohibitions

By using Nuntaria, you agree to comply with the following prohibitions:

Do not alter, decompile, or interfere with the security, integrity, or operation of the platform. Security-related violations will result in permanent removal of your access to Nuntaria, without prejudice to any legal action that may be taken.

7. Plans, Payments, and Billing

Access to Nuntaria's functionalities requires subscription to a monthly or annual plan. Payments are processed securely through Stripe, an external provider specialized in payment services. Nuntaria does not store banking information or credit card data. By subscribing, you authorize recurring charges according to the selected plan, until you decide to cancel your subscription.

8. Refund and Dispute Policy

In accordance with Colombian consumer protection regulations, you have the right to request a refund if the purchased product does not correspond to what was offered, presents unfixed faults, or if you decide to exercise the right of withdrawal within five (5) business days following the initial purchase. Requests must be sent in writing to the support email, including justification and payment information. Nuntaria will review each case in accordance with applicable law.

9. Cancellation Policy

You can cancel your subscription at any time from your account. Access to the service will continue to be active until the already paid period ends. No additional charges will be generated after cancellation.

10. Terms Applicable to Promotions

Promotions and coupons offered by Nuntaria have specific validity and conditions that will be informed at the time of their publication. They are not cumulative nor exchangeable for money, except as legally required.

11. Free Trial Period

We offer a 30-day free trial period. During this time, you can access all functionalities at no cost. At the end of the period, if you do not cancel previously, automatic billing will begin according to the selected plan.

12. Service or Price Modifications

Nuntaria may update, modify, or discontinue any functionality, plan, or rate, by previously notifying active users with reasonable advance notice. Modifications will not retroactively affect payments already made.

13. Limitation of Liability

Nuntaria guarantees the provision of the service during the validity of each active subscription, according to the functionalities offered at the time of contracting. However, access to the data used by the platform depends on official sources from the Colombian government, which may modify, restrict, or suspend their availability without prior notice.

In the event that these changes affect the continuity or quality of the service, Nuntaria will inform affected users and may offer proportional solutions, such as subscription adjustments or partial refunds, in accordance with current regulations.

The service is provided in its current state, without express or implied warranties regarding its uninterrupted availability or freedom from errors. To the extent permitted by law, Nuntaria will not be liable for indirect, incidental, special, or consequential damages arising from the use of the platform, except in case of serious contractual breach by the provider.

14. Updates and Maintenance

We may perform automatic updates to correct errors, improve functionalities, and ensure system security. These tasks could temporarily affect service availability.

15. Intellectual Property

All rights to the name, logos, interface, source code, and content of Nuntaria belong to its developer. No intellectual property rights are granted to the user.

16. Privacy Policy

The processing of personal data is carried out in accordance with our Privacy Policy. We do not collect sensitive information. Data is stored on Google Cloud Platform servers in the U.S. and Stripe manages all information associated with payment methods.

17. Indemnification

The user agrees to indemnify and hold harmless Nuntaria and its developers against any claim, damage, expense, or liability arising from misuse of the platform or breach of these Terms.

18. General Provision

If any provision is deemed invalid, the others shall remain in effect. These Terms constitute the complete agreement between the parties and supersede any previous version.

19. Jurisdiction and Applicable Law

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the judges of the city of Bogotá D.C.
